The Platform is operated by EDUCRAFTERS, a sole proprietorship of Tushar Devarajbhai Padariya (Udyam Registration: UDYAM-MH-18-0061354, PAN: DZXPP9338F), with its principal place of business at 301-302, Building 3, Shanti Garden Sector 6, Shanti Gardens Road, Mira Road East, Mira Bhayandar, Mumbai Suburban, Maharashtra 401107 (“Platform Owner”, “we”, “us”, “our”).
1. Acceptance
By accessing, browsing, registering on, or using the Platform, you agree to these Terms & Conditions (“Terms”), our Privacy Policy, and Refund & Cancellation Policy. If you do not agree, do not use the Platform.
2. Services
nextAIR provides online educational and assessment services, including chapter-wise practice, predicted mock tests, performance analytics, adaptive coaching, AI-assisted hints and explanations, rank projections, notes and related digital content (collectively, “Services”). Services are delivered digitally; no physical goods are sold or shipped.
3. Eligibility
You must be at least 13 years of age. If you are under 18, use the Platform only with consent and supervision of a parent or legal guardian. You agree to provide true, accurate and complete information during registration and to keep it updated.
4. Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at nextair.neet@gmail.com of any unauthorised use.
5. Free and paid plans
We may offer free and paid plans (e.g. monthly or seasonal access). Fees, features and plan details are shown on the Website at the time of purchase. Prices are in Indian Rupees (INR); applicable taxes are shown at checkout.
6. Payments
Payments are processed through authorised payment gateways (including PhonePe and other RBI-regulated partners). We do not store your full card or UPI credentials. Your use of payment services is also governed by the payment provider’s terms.
7. Intellectual property
All Platform content — questions, explanations, software, design, logos, analytics and coaching logic — is owned by or licensed to the Platform Owner. You receive a limited, non-exclusive, non-transferable, revocable licence to access Services for personal, non-commercial exam preparation only. You may not copy, scrape, redistribute, resell or create derivative works from Platform content.
8. Acceptable use
- Do not use the Platform for unlawful purposes or in violation of Indian law.
- Do not attempt to bypass security, scrape the question bank, or automate access.
- Do not share account access or distribute content outside the Platform.
- Do not upload harmful, abusive or infringing material.
9. AI-assisted features
Hints, explanations and coach responses may use AI assistance. They are for learning support only, not guaranteed to be error-free or exam-official. nextAIR is not affiliated with NTA, NEET, NMC or any exam conducting body.
10. Disclaimer
Services are provided “as is” and “as available”. We do not warrant uninterrupted access, specific rank outcomes, or that content matches any future official paper. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, the Platform Owner shall not be liable for indirect, incidental, special, consequential or punitive damages. Our aggregate liability for any claim relating to the Services shall not exceed the amount paid by you in the 12 months preceding the claim, or ₹100, whichever is higher.
12. Indemnity
You agree to indemnify and hold harmless the Platform Owner from claims arising from your breach of these Terms, misuse of the Platform, or violation of applicable law.
13. Force majeure
We are not liable for failure or delay caused by events beyond reasonable control, including internet outages, natural disasters, government action or third-party service failures.
14. Modifications
We may update these Terms at any time. Material changes will be posted on this page with an updated “Last revised” date. Continued use after changes constitutes acceptance.
15. Governing law & jurisdiction
These Terms are governed by the laws of India. Courts at Mumbai Suburban, Maharashtra shall have exclusive jurisdiction, subject to your rights under the Consumer Protection Act, 2019.
